Sorry but, could I ask for a description of the intent here? I can only guess at what your desire is unless you elaborate a bit more than just the title here.
For now, I will take a guess and hope it is in the right direction.
The only change I see in your settings is that you have selected to "flatten" instead of ignore (or "do not copy") comments into the newly generated file. With those options as they are, what you are seeing should be entirely expected.
As the merge function generates a new file, the first settings you show indicate that the comments should not be included, and so you only see the base content (this is what happens in your screenshots, so I would say this is working). In the second set, where you have "flatten" enabled, again, the input document is processed, and the existing comments are flattened into base content, then included in the newly generated file (again this seems to be what happened in your screenshot, so I would again say this is working).
Is there something wrong with this process?

I cannot say that we are able to reproduce this behaviour you are describing, could I ask you to please send us a copy of the original PDF sample file you are working with, and an export of your PDF-Tools "tools": so we can test here using the same settings you are and possibly identify what outside of the split/merge tool could be part of this issue?

My apologies, you did indeed send the PDF document, it was a force of habit to ask for the file at the same time as the settings export for tools issues, in any case, I do not have an export of your PDF-tools "tools" which I will need to reproduce this issue with.
